Terms of Service

By installing or using Tax Captain you agree to these terms. If you do not agree to them, do not use the app.

1. What Tax Captain is

Tax Captain is a record-keeping tool for work travel and business expenses. It records what you tell it and what it measures, and organises that into reports you can export.

2. What it is not

Tax Captain does not provide tax, accounting, financial or legal advice. It does not tell you what you may claim, and nothing it produces is a substitute for advice from a registered tax agent. We are not registered tax agents.

Tax Captain is not affiliated with, endorsed by, or approved by the Australian Taxation Office, the Tax Practitioners Board, or any other government agency. References to ATO methods describe publicly available rules and may not reflect the most recent determination — rates and requirements change, and checking them against ato.gov.au is your responsibility.

3. Your records are your responsibility

You are responsible for the accuracy and completeness of what is recorded, for reviewing what the app suggests before relying on it, and for keeping your own copies. The app deliberately flags figures it could not verify and kilometres it could not account for; those flags are there to be read.

Because there is no server and no account, we hold no copy of your records and cannot recover them. If your device is lost, damaged, reset or the app is deleted without an export, the records are gone. Export regularly.

4. Measurement is approximate

Distances come from your phone's satellite positioning and are subject to its accuracy, to the permissions and power settings you have applied, and to the operating system's decisions about what apps may run in the background. Automatic detection may miss a drive or measure one imperfectly. Estimates of fuel, running costs and emissions are orientation figures, not audited ones.

5. Licence

You are granted a personal, non-exclusive, non-transferable licence to use the app on devices you own or control. You may not copy, modify, reverse engineer, redistribute or resell it, except where that restriction is prohibited by law.

The app, its name, its design and its content remain ours. The records you create with it remain entirely yours.

6. Third-party services

Maps, satellite imagery and address lookups are provided by third parties, including OpenStreetMap and Esri. Their availability and accuracy are outside our control, and your use of them is subject to their terms. App store distribution is subject to Apple's or Google's terms as well as these.

7. Availability and changes

The app is provided as it is at the time you install it. We may change, suspend or discontinue it, or any part of it, at any time. Because the app runs entirely on your device, a version already installed will keep working whether or not it is updated.

8. Disclaimer and liability

To the maximum extent permitted by law, the app is provided "as is" without warranties of any kind, and we are not liable for any loss arising from your use of it — including lost records, missed or inaccurate trips, or the tax consequences of anything it produced or failed to produce.

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where our liability can be limited but not excluded, it is limited to resupplying the app or paying the cost of resupply.

9. Governing law

These terms are governed by the laws of Western Australia, Australia.
